Official Terms and Conditions for all Competitions

PURCHASE OF AN ENTRY PACK IS NECESSARY TO ENTER THIS CONTEST. VOID WHERE RESTRICTED OR PROHIBITED BY LAW. OPEN TO RESIDENTS OF THE UNITED STATES OF AMERICA, CANADA, THE EUROPEAN UNION, AND OTHER NATIONS, STATES, PRINCIPALITIES, TERRITORIES, COMMONWEALTHS OF THE WORLD.

Entry constitutes your acceptance of these Official Terms and Conditions.

 

Sponsor: The sponsor of the Competitions is the Institute for the Study of Succession and Continuity (“Sponsor”).

Entry Dates:

All Competitions will end on , 11:59 pm EST (“Submission Period”). You must submit all entry materials as outlined below by  11:59 pm EST to be eligible to receive a prize. No late entries will be accepted.
 
Eligibility: This Competition is open to all Persons, which shall be construed to mean and include an individual, partnership, association, organization, corporation, club, company, trust, estate, society, joint-stock company, receiver, trustee, assignee, referee, or any other person acting in a fiduciary capacity, or representative capacity, whether appointed by a court or otherwise, and any combination of individuals. Person shall also be construed to mean and include agencies, and instrumentalities of the State, and counties, cities, towns, and villages. Residency within the fifty (50) United States or the District of Columbia is not a requirement. You must have reached the age of eighteen (18) in the state where you reside as of the start date of this Competition. If you are below the age of eighteen (18) but above the age of thirteen (13), you must obtain a written consent from your parent or legal guardian in order to be eligible for the Competition. If you are under age of thirteen (13), please do not attempt to register for the Competition or provide any personal information about yourself to us. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. If you believe that we might have any information from a child under age 13, please contact us through this help page. Employees (and their immediate family members and members of the same household) of the Institute for the Study of Succession and Continuity and their respective affiliates, agents, and assigns are not eligible to participate in this Competition. Due to Congressional and Executive Branch ethics rules, members of Congress, Congressional staff, Executive Branch officials and their staff members are not eligible to participate in this Competition. The winners of this Competition must meet these eligibility requirements to receive the prize.

How to Enter: All eligible individuals may enter this Competition individually or in a team of up to fifteen (15) members. You can enter one or more Competition. All teams must select one person and two (2) alternates to represent the team and submit the entry materials and receive the prize (if awarded) on behalf of the team. To enter the Competition (1) Create a scenario of the destruction of the particular Entity or Entities (United States, European Union, Israel, Vatican, New York) by following the Guidelines outlined in these Official Terms and Conditions; (2) Complete the online entry form located on this LINK and send your entry during the Submission Period according to the guidelines outlined in these Official Terms and Conditions. 

Entry Guidelines: You must create a scenario of the destruction of the Entity or Entities, which you have chosen. Accordingly, this must not just be from the traditional and easily-recognizable, e.g.:
  • Guns
  • Bladed weapons
  • Bombs
  • Known or stockpiled weapons of mass destruction
  • Atomic or nuclear weapons
  • Computer hacking
  • Chemical Poisoning
  • Known biological weapons
  • Meteors from outer space
  • Invaders from outer space
  • Immigration
  • Conspiracy Theories of so-called secret societies
  • Economic depressions/recessions modeled from historical facts
  • Or anything of similar nature as determined by Competition organizers or ISSC.
Your entry must address the following:
We’re looking for, but not limited to, processes, methods, delivery systems, networks, inventions, innovations, discoveries, from all known unknown fields and disciplines, from the arts to the sciences, that push the boundaries of human imagination and may someday threaten our current civilization.
 
You are strongly encouraged to make the following in your entry:
You are strongly encouraged to use your own original material in the creation of your entry.  This includes but is not limited to: music, film, video, photography, graphics, sound clips, and any other types of audiovisual materials.

Individual:
Early entry: $15
Regular entry: $15

Group:

  • Two (2) to four (4) members: $20 each member
  • Five (5) to seven (7) members: $25 each member
  • Eight (8) to ten (10) members: $30 each
  • Eleven (11) to thirteen (13) members: $40 each member
  • Fourteen (14) to fifteen (15) members: $50 each member

Upon payment of an entry fee, you will receive the following:

One (1) Entry Packet

3.      One (1) FREE copy of the ebook, “America’s Greatest Challenge Succession and Continuity” by Joseph S. Bayana, for each member of the group.
If you choose to join more than one Competition, or submit more than one entry in any or all the Competition, you will be required to pay for the additional corresponding entry fee for each and every Competition.
 
You will only be allowed to merge or join other groups, not exceeding fifteen (15) members, after payment of corresponding entry fee/s and submission of HUT documents. Sponsor must be notified in writing, with a signed agreement from representatives of all consenting parties, three business (3) days before an individual joins a group or before a merger of two or more groups. You have the sole responsibility to ensure that an individual joining a group, or a group/s merging with another group, does not constitute replicas, copies, repetitions or redundancies of HUT documents. Sponsor reserves the right and has sole discretion to interpret HUT documents.
 
Entry of individual/s and/or group/s in any or all competition/s, and replicas, copies, repetitions or redundancies of HUT documents, does not constitute a circumvention of group entry fees or any of the Terms and Conditions stipulated herein.
 
Transactional Information: Only entry fees using online payments via Paypal or any major credit card will be accepted. Sponsor does not accept entry fees paid in person, or sent via post mail or courier using cash, personal or company check, money order or other financial instruments.  Sponsor reserves the right to retain the details of transactions or payments you make.
 
Your entry must comply with the following content guidelines:
- Content may contain any material that, in the sole judgment of Sponsor, infringe on the intellectual property rights of any third party, including but not limited to, copyrights or trademarks owned by others. However, we strongly encourage you to use your own original material in the creation of your video. If you wish to use third party material in your video, including but not limited to: any song, musical composition, or sound recording; material from any music video, motion picture television program, video game, or other audiovisual work; any photograph, graphics or other work of visual art; text or other material from any book, magazine, article, or other publication, you must obtain all appropriate permissions to use any such material in your video. If your entry contains any third party material, you will be required to submit to Sponsor appropriate legal documentation that demonstrates (to Sponsor’s satisfaction) that you have received proper permission to use such material in your entry for all purposes related to this Contest and Sponsor, with a right to further grant and transfer such permission to Sponsor and its affiliates. Failure to provide appropriate legal documentation, as determined in Sponsor’s sole discretion, will result in disqualification of your entry in the sole discretion of Sponsor and without notice to you;
 
- Content cannot advertise or promote any third party brand or product of any kind, or contain any personal identification, including but not limited to, license plate numbers, personal names, e-mail addresses, phone numbers, or street addresses, unless Sponsor determine this as necessary;
 
- Content cannot contain materials embodying the names, voices, likeness, or other indicia of, or identifying, any person, living or dead(other than yourself and/or your team members), unless appropriate permission and releases have been obtained for your use of such material in your entry. You will be required to submit signed releases to the Sponsor for all persons featured in your entry. Failure to provide this documentation will result in disqualification of your entry in the sole discretion of Sponsor without notice to you;
 
Sponsor reserves the right to disqualify any submission for any reason, in its sole and absolute discretion, including the determination that a submission fails to satisfy any of the above requirements, or is inconsistent with the goals, image or policies of the Sponsor.
 
SUBMISSION GUIDELINES:
To submit your entry (“Submission”) you must do the following:
1. Purchase an entry pack at www.greatestchallenge.org
2. Complete the online entry form.
3. Agree with the "Terms and Conditions" of the Competition.
4. Click on the “Submit Your Application” button found therein

Winner Selection: Upon submission of your entry, all eligible entries received will be reviewed to ensure their compliance with the Competition Guidelines. Upon approval by Sponsor, entries will be posted for public viewing on the ISSC website, www.greatestchallenge.org. In order for your entry to move on to the Round 1 Judging phase, your entry must be among the top 25 for each Competition chosen by the panel of Judges. Only the top 25 entries for each Entity will proceed to the next round of judging. Sponsor’s determination as to entries chosen shall be final, and Sponsor reserves the right to not accept fraudulent entries or declare a no-contest if entries in some, or all, of the Competition/s do not meet standards based on the Sponsor’s sole discretion. You will be notified via post mail or courier on March 18, 2011 if your entry is selected to move on to Round 1 of judging.

Round 1: The Top 25 entries that progress to Round 1 phase will be judged by a panel of Judges, selected by Sponsor staff, consisting of individuals with expertise in the multi- and inter-disciplinary areas of, but not limited to, business, economics, political science, philosophy, history, national security, weaponry, physics, chemistry, and/or entertainment (hereinafter collectively “Judges” and individually “Judge”) according to the following selection criteria: 1) originality; 2) imaginative story-telling in the Submission; 3) the discovery, invention, and/or innovation of current/future threats described in the Submission, and 4) creativity (the “Judging Criteria”). Five entries will be selected as finalists and will move to Round 2 judging phase. The Judges, in their sole discretion, will select the five (5) finalists that will advance to Round 2. The Judges reserve the right to select alternative finalists, fewer than five (5) finalists, or no finalists, if, in their sole discretion, the Contest does not receive a sufficient number of eligible and qualified submissions. All finalists will be required to sign and return an Affidavit of Eligibility, Consent Form for Background Check, and a Liability and Publicity Release. For teams, each team member must sign and return the Affidavit, Consent Form, and the Release as well as any other documents which may be required by Sponsor, all of which must be received fully- executed within five (5) business days of date printed on notification or you may be disqualified. Finalists consent to a background check. Sponsor reserves the right to determine factors that will result in disqualification as a finalist. Having been charged with or convicted of a felony or misdemeanor or, being delinquent on a government ordered payment, such as child support, spousal support, alimony, tax payments, just to name a few examples, are not grounds for disqualification. You will be notified on April 7, 2011 if you are selected as a finalist. The Judges shall have the sole authority and discretion to select the finalists, and all decisions of the Judges shall be FINAL. By entering this Contest, you agree to be bound by the decisions of the Judges.

Round 2 The five (5) finalist entries will be featured at the ISSC website (www.greatestchallenge.org), unless Sponsor decides, based on its own discretion, to withhold information about the entry, especially if it concerns matters of personal, national and/or global security.
 
Finalists are prohibited from obtaining Judges’ votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the ISSC staff and the Judges in exchange for high scores, as determined by Sponsor in its sole discretion. Use of methods or processes with the intent to subvert or impair the integrity of the scoring process is strictly prohibited and all such scores will be void. The finalist with the highest scores, as determined by Sponsor in its sole discretion, will be deemed the First Place Award recipient, subject to verification of eligibility and compliance with these Terms and Conditions. The finalist with the second highest number of valid votes, as determined by Sponsor in its sole discretion, will be deemed the Second Place Award recipient, subject to verification of eligibility and compliance with these Terms and Conditions. The finalist with the third highest number of valid votes, as determined by Sponsor in its sole discretion, will be deemed the Third Place Award recipient, subject to verification of eligibility and compliance with these Terms and Conditions. Sponsor reserves the right not to provide any and/or all awards if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries. Winners will be notified via email, post mail or courier on May 2, 2011 and announced on May 2, 2011.
 
If, in Sponsor’s sole discretion, it is determined that any entry has not complied with these Official Terms and Conditions; Sponsor is unable to contact a selected applicant within a reasonable time period; a selected applicant has failed to properly execute and return any required documents within the specified time period; has made false statements or notification is returned as undeliverable; fails the background check; then such submission will be disqualified. Should any selected applicant make any false statement(s) in any document required by Sponsor, such applicant will be disqualified. If any applicant or winner is disqualified for any reason, at Sponsor’s discretion, a runner-up may be selected and/or issued the Award, at Sponsor’s sole discretion.
 
Sponsor’s decisions are final and binding on all matters.

Destroying New York: $50,000
 
THIS CONTEST HAS NOT PREVIOUSLY BEEN OFFERED.
 
Delivery of Prize: An award ceremony event to deliver the prize money will occur on or before May 2, 2011 at a location to be determined (TBD). Winners are solely responsible for airfare and hotel accommodations to the award ceremony, unless Sponsor determines otherwise. Winners currently residing in the United States (and all team members if applicable) must be present at the event to claim your prize. FAILURE TO ATTEND THE AWARD CEREMONY EVENT WILL RESULT IN FORFEITURE OF YOUR PRIZE. Winners residing outside of the United States at the time of the awards are not required to attend the award ceremony event. Obtaining a visa into the United States is the sole responsibility of the winner/s. Prizes awarded to a team will be delivered to the individual designated as the team representative. Four (4) checks will be issued, in four (4) equal payments for each prize, payable to the individual winner or team representative for team winners. A winner residing outside the United States is required to have a legitimate bank account, and will receive the prize via bank transfer. A legitimate bank account is the sole responsibility of the team. Sponsor reserves the right to hold a prize in the event the legitimate bank account of the winner cannot be established. Distribution of prize money between team members is the sole responsibility of the team. Entrants, including all team members jointly and severally, agree to indemnify, and hold Sponsor, its affiliates, and their respective officers, directors, employees, agents, contractors, and assigns, harmless from and against any and all liability and claims arising from the delivery and/or distribution of the prizes.
 
Miscellaneous: All taxes and other expenses associated with the prize unless otherwise stated herein are the winners’ sole responsibility. Sponsor will file and issue to each winner a 1099 IRS tax form for all prizes awarded. Winners must provide all necessary information to complete the required tax filing. Sponsor reserves the right to substitute a prize of equal or greater value. No other substitutions of prize permitted.
 
General: This Competition is void where prohibited or restricted by law and is subject to applicable federal, state and local laws and regulations. The Institute for the Study of Succession and Continuity and its affiliates, are not responsible for and disclaims any and all liability for late, lost, stolen, damaged, incorrect, incomplete, illegible, postage due, garbled, misaddressed, or misdirected delivery of prize to winner. Sponsor reserves the right, at its sole discretion, to disqualify any entrant if his or her fraud or misconduct affects the integrity of the Competition. By participating in this Competition, each entrant (for teams, all team members jointly and severally) accepts these Official Terms and Conditions, agrees to be bound by the decisions of the Judges and warrants that s/he is eligible to participate in this Competition. By accepting prize, winner (for teams, all team members jointly and severally) agrees to release the Institute for the Study of Succession and Continuity, its affiliates, and their respective directors, employees, officers, assigns and agents, including without limitation, their advertising and promotion agencies, from any and all liability, loss or damages arising from or in connection with the awarding, advertising, receipt, and/or use or misuse of prize or participation in any prize-related activities.
 
Personal Information: By entering this Competition, you agree and consent to Sponsor’s collection, use and retention of your personal information as disclosed on the Institute for the Study of Succession and Continuity website for all purposes related to this Competition (including, but not limited to, processing and administering entries, sharing an entrant’s personal information with Sponsor’s service providers and contractors as necessary to conduct and operate this Competition, communicating with and awarding prizes to winners, conducting background checks, making public announcements about winners, and advertising, promoting and publicizing this Competition). Please review Sponsor’s Privacy Policy at www.greatestchallenge.org before disclosing your personal information on the entry form. If you object to the above or anything stated in Sponsor’s Privacy Policy, you should not sign the entry form or participate in this Competition.
 
Fraud in Online Entries Strictly Prohibited: Use of any automated entry software is prohibited. Online entries made with multiple email addresses, under multiple identities or through the use of any other device or artifice to enter multiple times will be deemed invalid. If the winner is an online entrant, the winning online entry will be deemed to have been submitted by the authorized representative of the company, individual, or team, for which the entry was made as listed on the online application. Sponsor shall not be responsible for incorrect or inaccurate transcription of entry information, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or website, inability to submit the online entry form, or any other error or malfunction, or any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading or uploading any materials in this Competition, or for late, lost, stolen, postage due, illegible or misdirected entries. If this Competition or any website associated therewith (or any portion thereof) becomes corrupted or otherwise does not permit entry in the Competition, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in Sponsor’s sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper operation of this Competition, Sponsor reserves the right, at its sole discretion, to disqualify any entrant implicated in such action, and/or to cancel, terminate, modify or suspend this Contest or any portion thereof.
 
Caution: ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
 
Intellectual Property Rights: ISSC makes no claim to ownership of your Entry or any intellectual property that it may contain. You are not granting ISSC any rights to any patents or pending patent applications related to anything described in your Entry. By submitting an Entry, you grant ISSC certain limited rights as set forth in these terms. You agree that this consent is perpetual and cannot be revoked. For uses beyond the consent that you grant above, you agree that ISSC’s use of your personal data will be governed by the Privacy Policy posted on the www.greatestchallenge website. You agree that nothing in these Rules grants you a right or license to use the ISSC name or any ISSC trademark or service mark.
 
Grant of Rights: By entering this Competition, you (in the case of a team, all members of your team jointly and severally) expressly grant to Sponsor and its affiliates, licensees, agents, representatives, successors and assigns, a worldwide, royalty-free, irrevocable, perpetual, non-exclusive license to use, publish, reproduce, perform, exhibit, broadcast, distribute, transmit, edit, modify, adapt, and create derivative works from, your entry submission in this Competition, or any portion thereof, in any and all media now known or hereafter devised (including, without limitation, television, radio, film, Internet, mobile, digital downloads, CD- ROMs, DVD’s and other pre-recorded media, and publishing and editorial media) and for any and all purposes of Sponsor (commercial and non-commercial), including, without limitation, using your entry in connection with the advertising, promotion, publicizing, operation and conduct of the projects by the Institute for the Study of Succession and Continuity (and/or such other present or future campaigns of Sponsor), all without attribution or compensation to you (or to any of your team member).
 
Also, by entering a Competition, you (in the case of a team, all members of your team jointly and severally) expressly grant to Sponsor and its affiliates, assignees, licensees, legal representatives and transferees, a worldwide, royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, publish, portray and display your name, likeness, voice and biographical information as contained in your entry in this Competition, as well as your prize information (if you or your team is selected as a winner), in connection with exploiting your video as permitted in the preceding paragraph.
 
You (in the case of a team, all members of your team jointly and severally) agree to indemnify and hold the Institute for the Study of Succession and Continuity, its affiliated entities, and their respective employees, officers, agents, licensees, and assigns, harmless from any all liability arising from your failure to obtain the permissions and grants of authority described in these Terms and Conditions. You further waive any and all rights to review or approve any use by the Institute for the Study of Succession and Continuity of your entry, images, likenesses, photographs, sounds, recordings or voices, contained therein. You acknowledge that the Institute for the Study of Succession and Continuity and its agents, in their sole discretion, may choose not to use your entry or derivatives thereof.
 
Warranty of Title / Licensing of Rights: By entering this Competition, you (in the case of a team, all members of your team jointly and severally) warrant and represent that you either own all right, title, and interest in and to any protectable content (including, but not limited to, copyrighted material or proprietary information) contained in the entry or, if your entry contains content that would infringe any rights owned by a third party, that you have secured the right to use such content and to license the same to the Institute for the Study of Succession and Continuity under the terms set forth herein. With the above understanding, you further grant and assign to the Institute for the Study of Succession and Continuity an irrevocable, perpetual, royalty-free, transferable license in the entry (including all content and rights contained therein, including content owned by a third party) for all possible uses in any and all media, whether now known or hereafter devised, including, without limitation, all rights of every kind and nature, including the right to edit, modify, alter, reproduce, copy, broadcast, or publish the entry in its entirety or of any portion thereof individually, and the right to create derivative works thereof and/or to combine any content with third-party works. You (in the case of a team, all members of your team jointly and severally) further agree to indemnify and hold the Institute for the Study of Succession and Continuity, its affiliated entities, and their respective employees, officers, directors, agents, licensees, and assigns, harmless from any all liability arising if through oversight, negligence, or willful misconduct, should the entry contains material that violates any third party’s rights.
 
Rights Reserved. Sponsor reserves the right to change these Official Rules and Terms and Conditions at any time, in its sole discretion, and to suspend or cancel the Competition or any entrant's participation in the Competition should unauthorized human intervention or other causes beyond Sponsor's control, affect the administration, security, or proper play of the Competition. No responsibility is assumed and entrants waive all claims for lost, late or misdirected entries, or for any problems of technical malfunction of any telephone or network lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry received by Sponsor on account of technical problems or traffic congestion on the Internet, the website or any combination, thereof including, without limitation, any injury or damage to entrant's or any other person's computer resulting from any causes, including without limitation downloading any materials in the promotion. Entrants who violate these Official Rules, tamper with the operation of the Competition or engage in any conduct that is detrimental or unfair to Sponsor, the Competition, or any other entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Competition. Sponsors reserve the right to modify, withdraw or terminate this Competition at any time without prior notice. Sponsor reserves the right to lock out any entrant whose eligibility is in question.
 
Waiver: By entering the Competition, you waive all rights to seek injunctive or equitable relief, or to claim punitive, incidental or consequential damages, or attorneys’ fees.
 
Disclaimer: A great part of the proposal for this project was submitted as an entry to the National Cybersecurity Awareness Campaign Challenge of the United States Department of Homeland Security. ISSC does not, in any form, sort, way, and/or manner, condone, support or tolerate terrorism.
 
Law: All terms and agreements shall be governed by the laws of the United States and the State of New York.
 
Name of Winners: For the name of the winners, send a Self Addressed Stamped Envelope (S.A.S.E), received by ____Insert Date_______ to: _Attn: ISSC, P.O. Box 624, Islip NY, 11751. Winners’ names will not be mailed until after all winners have claimed the prize according to the terms of these Official Terms and Conditions.
 
Privacy Policy
There is no expectation of privacy. The information you send, including your personal information, will be shared with those with an official need to know. Once submitted, you have no control over the uses of the information. However, your information is protected by security safeguards that protect from unauthorized viewing and sharing with third parties. The Institute for the Study of Succession and Continuity reserves the right and has the sole discretion to provide individuals and organizations with any and all information obtained from entries or parts thereof.
